Most of us take the mental capacity to carry out a common task or make an important decision for granted. However, mental capacity can be affected by a variety of illnesses such as depression, anxiety or dementia, resulting in reduced ability to make specific decisions. To have mental capacity the individual must be provided with information about the choices they face, and must be able to understand and retain this information, weigh the choices in the balance and make a decision.

Impairment of mental capacity may have legal implications. For example, if you draw up a legal document such as a will or lasting power of attorney, and your mental capacity is questioned at a later date, that document may be overturned by the court, so your wishes may not be followed. If you (or someone you care for) live with a condition like dementia or depression and you need to take an important decision, it is important that an assessment is made of your mental capacity in order to prevent the decision being challenged in the future.

Testamentary capacity is a specific type of capacity where a person has the ability to draw up a valid will. To have testamentary capacity a person must be able to understand the purpose and effect of a will, who the potential beneficiaries are, the approximate size of their estate and be free of an illness which affects their judgement.

Although some legal and financial advisers are experienced with assessing people’s capacity, often a medical opinion is essential. Our consultants are experienced in complex capacity assessments, including testamentary capacity. We offer a bespoke, comprehensive assessment and are happy to work collaboratively with solicitors and financial advisers to ensure you receive a first class service.

 

LPA Certificate Provider

A lasting power of attorney (LPA) allows a ‘donor’ to appoint one or more people (the ‘attorneys’) to make decisions on their behalf. Our consultant psychiatrists can assess a donor to ensure they have capacity at the time that they grant an LPA, and will provide a certificate.

Second Opinion

Mental capacity assessments may sometimes need a second opinion; for example when capacity is assessed by two different professionals and the decision or outcome differs; when there is dispute as to the validity of a previous decision; or when a GP or other professional requests a second opinion. Red & Yellow Care have expert consultants who are able to provide this service.

Retrospective Capacity Assessments

A retrospective capacity assessment may be needed when decisions made in the past are questioned by someone in the present. They may believe the individual lacked mental capacity to make a decision at the time, for example about setting up a Lasting Power of Attorney, writing a will or donating valuable gifts.       Clinical Psychology in Later Life

      There are times when everyone feels stressed or unhappy. Generally these bad times pass but sometimes we have problems that do not go away and things get harder and harder. Talking about your problems can really help.

      Clinical Psychologists aim to help people understand and cope with problems they may be experiencing more effectively. They aim to help people understand the way they think, act and feel in order for people to make changes which reduce difficulties and lead to a better quality of life.

      Clinical Psychologists use a variety of therapeutic models and techniques to meet your individual needs. These may including cognitive-behavioural techniques and systemic approaches. You may have heard these described as “talking therapies”. We do not prescribe medication. Clinical Psychologists work with people of all ages, either individually or as part of a family or couple unit.

      What happens next?

      If you are interested in meeting with a Clinical Psychologist we will arrange an initial psychological assessment appointment. This will enable us to discuss your difficulties and what type of psychological intervention might be most helpful to you at this time or whether some other support might be more beneficial. You are welcome to invite whoever you choose to this appointment. We often find that family and friends have valuable ideas to add to our discussions.

      There is no pressure for you to arrange anything more than this to begin with. The Clinical Psychologist will spend time with you at the end to discuss how you found the meeting, what goals you have and whether you would like to arrange further sessions. This is a collaborative approach so we will work together to come up with ideas which might be helpful to you rather than telling you what to do. We offer a personalised and flexible service and tailor the psychological approach we use to best meet your needs. We also maintain the strictest standards of confidentiality.

      Psychological Therapies

      Cognitive-behavioural therapy (CBT)

      CBT focuses on your current difficulties and looks for practical ways to help you overcome your problems on a daily basis. It aims to help you identify and break unhelpful patterns of thinking, feeling and behaving.

      Systemic family work

      We live our lives in all kinds of groups, systems and relationships. We can meet with individuals, couples, families or other groups to help you find what works for you and those around you. We look at existing strengths and resources within the system and how these can be developed further. Sometimes there are a variety of different ideas within the family on what the problem is and how to manage it. It can be helpful to work together on changes that might be useful. We do not take sides but try to offer support and guidance to help create real change that can benefit everyone in the system.

      Cognitive Stimulation Therapy (CST)

      Cognitive stimulation therapy is a brief group treatment for people with mild to moderate dementia. It is the only non-drug intervention to be recommended for cognitive symptoms and maintenance of function. CST generally involves 14 or more sessions of themed activities. The group sessions aim to actively stimulate and engage people with dementia, providing a great learning environment as well as the social benefits of a group.

        Speech & Language Therapy in later life.

        Speech and Language Therapy provides treatment and support for anyone who has difficulties with communication, their cognitive (thinking) skills and/or swallowing.

        A Speech and Language Therapist (SALT) will assess a person’s eating and drinking skills to ensure they are tolerating their oral intake without coughing, choking or aspirating (when food or fluids ‘go down the wrong way’). A SALT may assist in preventing chest infections (aspiration pneumonia) and potential hospital admissions if they are able to provide the appropriate assessment, treatment and advice. In order to do this they may recommend safe-swallow strategies, a modified diet and/or fluids.

        A SALT can also use cognitive communication intervention to maximise strengths and address weaknesses related to underlying structures and functions that affect a person’s talking, understanding and executive function (such as memory, problem solving, planning skills or initiation). A SALT facilitates activity and participation by assisting the person to acquire new skills and strategies. Speech and Language Therapy can support a person to use effective compensatory behaviours, communication techniques, strategies or self-regulatory skills. It will also include the education of family and caregivers to help them support these interventions.

          Occupational therapy (OT) is the use of treatments to maintain, recover or develop the daily living and work skills of people with a mental or physical illness. Occupational therapy is centered around you; it places a premium on the progress towards your goals and promoting your independence. OT interventions will  focus on adapting your environment, modifying the task, teaching the skill and educating the client/family in order to increase participation and performance of daily activities, particularly those that are most meaningful to you.

              Over one million older people in the UK now have a mental illness that could affect their capacity to carry out certain tasks or make important decisions. The courts and regulators now expect professionals to assess whether the presumption of capacity should be set aside and, if so, what to do. Recognising mental illness, and assessing subtle impairment of capacity, may be difficult without training.
